Summary Judgment Granted in General Liability Action
In December of 2013, Amanda L. Tate was awarded summary judgment on behalf of a hospital defendant in a general liability action involving purported violations of the Labor Law and Industrial Code, in addition to allegations of general negligence. The case involved a plaintiff who injured himself during a workplace-related construction accident, wherein an alleged dangerous condition was purportedly present on the subject-matter property.
Following extensive litigation, involving third and fourth-party plaintiffs and defendants, we were able to carve out the role of each defendant, based upon relevant deposition testimony and documentary evidence and successfully eliminate liability as to our client. Moreover, the summary judgment motion was argued in various prongs, carefully refuting liability as to each cause of action alleged within the Labor Law and Industrial Code, by illustrating alternative and lateral analyses. The arguments in our motion logically flowed based upon our keen grasp of the intrinsic and complex facts of the case and our ability to understand the intricate precedent involving premises owner liability.
